Confidentiality of Circulation Records and Patron Information
In accordance with the Ohio Revised Code (“ORC”) section 149.432 dealingwith the confidentiality of library records, The Henderson Memorial Public Library Board of Trustees specifically recognizes that its circulation records and other records identifying the names of Library users with specific materials are confidential. No such records shall be made available to any agency of state, federal or local government, or to any individual not specifically authorized by the Library Director for legitimate business purposes, except pursuant to such process, order, or subpoena as may be authorized under the authority of, and pursuant to, federal, state, or local law relating to civil, criminal or administrative discovery procedures or legislative investigatory power.
Exceptions to this statute, as outlined in sections (B)(1-5) of this statute include:
1) The request of a parent, guardian, or custodian,
2) The production of some form of a court order or in light of an exigent circumstance,
3) The patron’s consent to release of his information,
4) For use in various administrative library purposes, and
5) To document improper use of the internet at the library.
Prior to releasing any information on a minor to a parent, guardian, or custodian, personal identification (driver’s license, birth certificate, etc.) must be produced to verify the relationship, and in some instances a court order verifying their role with regards to the minor may be required.
